COMUNICADO OFICIAL DE LA FUNDACI\u00d3N INTERNACIONAL DE EDUCACI\u00d3N ANTE LAS \u00daLTIMAS NOTICIAS DEL CENTRO DEPORTIVO NEWMAN<\/b><\/p>\n

Madrid, 12 de enero de 2024.-<\/p>\n

Desde la Fundaci\u00f3n Internacional de Educaci\u00f3n, titular del Centro Deportivo Newman del Barrio de las Rosas y, tras la orden de cierre de sus instalaciones por parte del Ayuntamiento de Madrid, queremos aclarar las\u00a0 siguientes consideraciones:\u00a0<\/span><\/p>\n

    \n
  1. Que el Centro Deportivo Newman <\/span>ha cumplido en todo momento la normativa aplicable,<\/b> siguiendo los procedimientos establecidos y realizando las gestiones administrativas conforme a las indicaciones que nos han ido solicitando los \u00f3rganos y entidades competentes.<\/span><\/li>\n
  2. Que al inicio del proyecto <\/span>se nos solicit\u00f3 un tipo de licencia que obtuvimos exitosamente<\/b> y que, con posterioridad, se nos solicit\u00f3 otro tipo de licencia (LEPAR), que presentamos siguiendo los cauces adecuados y cumplimentando todos los requerimientos de la misma.\u00a0<\/span><\/li>\n
  3. Que al poco tiempo, esta licencia que nos hab\u00eda solicitado el propio Ayuntamiento, <\/span>la declararon \u201cineficaz\u201d<\/b>, tras lo cual recurrimos v\u00eda contencioso-administrativa y el juzgado <\/span>acord\u00f3 conceder medidas cautelares<\/b> urgentes<\/b>, que suspend\u00edan la ejecuci\u00f3n de la orden de cierre y permit\u00edan continuar con los servicios del centro abierto al p\u00fablico.<\/span><\/li>\n
  4. Que <\/span>de una manera inusualmente celosa y acelerada, el Ayuntamiento recurri\u00f3 en apelaci\u00f3n al Tribunal Superior de Justicia<\/b> para revocar las medidas cautelares y llevar a cabo el cierre, sin esperar a la firmeza de la sentencia -que es recurrible-, con el consiguiente resultado de <\/span>1400 alumnos, familias del colegio y miembros del Club Deportivo Newman afectados, y m\u00e1s de 40 personas desempleadas.\u00a0\u00a0<\/b><\/li>\n
  5. Que el centro deportivo forma parte de las instalaciones del Colegio J.H. Newman y en \u00e9l <\/span>se desarrolla una actividad principal educativa,<\/b> en cuanto que centro docente concertado.<\/span><\/li>\n
  6. Que la parcela tiene una calificaci\u00f3n de uso dotacional, educativo b\u00e1sico, en la que <\/span>el uso asociado deportivo est\u00e1 permitido por la actual normativa urban\u00edstica.<\/b> Las instalaciones deportivas siempre tienen la consideraci\u00f3n de uso deportivo, aunque est\u00e9n abiertas al p\u00fablico. Y el uso asociado no se restringe exclusivamente a los usuarios de la actividad principal (alumnos del colegio y Club Deportivo Newman). Esa interpretaci\u00f3n vaciar\u00eda de contenido el concepto de uso asociado. Los alumnos del colegio pueden utilizar las instalaciones deportivas del centro sin necesidad de obtener licencia para el uso asociado deportivo, que sin embargo, en la medida que se abra a terceros usuarios, necesitar\u00e1 una licencia LEPAR (de Espect\u00e1culos abiertos al P\u00fablico y Actividades Recreativas). La normativa del Ayuntamiento, por tanto, permite el \u201cuso asociado\u201d precisamente con la finalidad de que los usuarios ajenos al colegio puedan usar las instalaciones del Centro Deportivo y que, sin embargo, posteriormente, el mismo Ayuntamiento afirma ante un Tribunal que \u201cuso asociado\u201d significa lo contrario (que s\u00f3lo puede ser usado por los alumnos del centro), lo que supone una contradicci\u00f3n<\/span><\/li>\n
  7. Que el suelo fue <\/span>cedido<\/b> por el Ayuntamiento por un plazo de 75 a\u00f1os y que, llegado ese d\u00eda, <\/span>revertir\u00e1 al Ayuntamiento la titularidad de todas las edificaciones, tanto del colegio como las recientemente edificadas, sin tener que sufragar coste alguno.<\/b><\/li>\n
  8. Que la Fundaci\u00f3n Internacional de Educaci\u00f3n en el inter\u00e9s del Colegio, de la Comunidad Educativa y de los potenciales usuarios de las instalaciones que son residentes del barrio, est\u00e1 implementando <\/span>todas las acciones legales que en Derecho puedan ser procedentes, <\/b>en defensa de sus leg\u00edtimos intereses y de los miembros del Colegio Internacional J.H. Newman y del Club Deportivo Newman<\/span>.<\/b><\/li>\n<\/ol>\n

    Con el deseo de seguir educando y construyendo por el bien de todos y abiertos a colaborar con quien as\u00ed lo quiera, esperamos que no prevalezcan otras interpretaciones inadecuadas que puedan oscurecer esta gran tarea.<\/span><\/p>\n
